18 U.S.C. 2257 Statement

SpicyAPI (also written Spicy API) has been at spicyapi.com since June 2025, and only there. It is operated by Wayfinity Ltd and is not affiliated with spicyapi.ai or any other service using a similar name.

All visual content produced through SpicyAPI is wholly computer-generated by AI models. Our Acceptable Use Policy prohibits depicting any real person in an image or video, with or without their consent; no photograph or video of a real person may be used as an input; and no performer, model or actor has participated in the creation of any image or video.

This is enforced by design, not by policy alone. Apart from the character import exception below, no uploaded or external image becomes part of an output: the only images that can be edited or animated are images previously generated by the same account, verified server-side before any request is processed, and a picture sent to the reference image model is described in words without identifying facial features and discarded, so the new image is drawn from the description alone. Every prompt is screened before generation and every generated image is reviewed before delivery, and any output that appears to depict a real identifiable person or a person under 18 is withheld and deleted. Character import. For platforms migrating AI-generated characters they already created, we may enable a character import feature on an individual account, for a limited period and number of images. It accepts only wholly synthetic images of fictional adults. For every image, the customer warrants that it depicts no actual human being and was not made from a photograph or video of one; every imported image is screened before it can be used, files carrying camera metadata are refused, and imports can be held for human review. Under Schedule 1 of our Terms of Service, if an imported image, or content made from it, nonetheless depicts an actual human being in sexually explicit conduct, the customer that imported it, and not SpicyAPI, is responsible as its producer for every obligation under 18 U.S.C. 2257 and 2257A and 28 C.F.R. Part 75.

Because no actual human being is depicted in any sexually explicit conduct, the record-keeping requirements of 18 U.S.C. 2257 and 2257A and 28 C.F.R. Part 75 do not apply to content generated through SpicyAPI, and no such records exist or are maintained. Wayfinity Ltd, trading as SpicyAPI, is not a producer of any depiction of actual sexually explicit conduct.

Customers who use generated content together with content of real performers in their own products remain solely responsible for their own compliance with 18 U.S.C. 2257 for that content, as set out in our Terms of Service and Acceptable Use Policy.
